Former President of the Republic of Moldova indicted in "Energocom" case

The General Prosecutor's Office informs that today, June 27, 2022, the former President of the Republic of Moldova was charged with committing the crime of exceeding official duties, committed by a person with public office, in the interest of an organized criminal group (art. 46, art. 328 paragraph (3) of the Criminal Code), within the criminal case called “Energocom”.

 

We remind you that, on December 29, 2021, the former President of the Republic of Moldova was recognized and heard as a suspect in the stated crime. We mention that the accusation refers to his actions during the years 2008-2009, when he held the position of First Deputy Prime Minister, Minister of Economy and Trade.

 

Specifically, he is accused that, from his position at that time, holding the position of First Deputy Prime Minister, Minister of Economy and Trade, he signed the opinion on the basis of which, in May 2008, the Director General of the SA " Energocom ”was concluded the contract regarding the purchase of electricity for the Republic of Moldova, with a foreign company Hungary, in a volume of 2 320 000 000 kw / h, for the period May 2008 - June 2009, contrary to the provisions of art. 82 of Law no. 1134 of 02.04.1997 regarding joint stock companies.

 

Thus, according to the provisions of the contract concluded with the foreign company, the price of electricity for the period May-September 2008 inclusive amounted to 0.053 US dollars for 1 kw / h, and respectively 0.058 US dollars for 1 kw / h for electricity delivered during the period between October 2008 and June 2009 inclusive, given that JSC "Energocom" had already negotiated and concluded two contracts for the supply of electricity at a price 29% cheaper.

 

As a result of the nominated actions, the state in the person of JSC “Energocom” was caused damages in particularly large proportions amounting to 11,927,173 US dollars, the equivalent of 123,957,916 lei, funds that were subsequently transferred to the accounts of some offshore companies.

 

At the same time, these actions led to an increase in electricity tariffs, affecting the rights of final consumers, citizens of the Republic of Moldova.

 

We note that, during today's hearings, the ex-President of the Republic of Moldova did not admit his guilt in committing the deed of which he is accused, maintaining the statements given as a suspect.

 

Subsequently, we note that, regarding it, the procedural measure of coercion was maintained in the form of the obligation to appear before the criminal investigation body, under the conditions provided by art. 198 of the Code of Criminal Procedure.

 

After completing all the planned criminal prosecution actions and adopting the solution on the case, we will come with additional information.

 

Note: The person accused of committing a crime is presumed innocent as long as his guilt is not established by a final conviction.
