Artikel 116
Status of Judges

(1) Judges of the courts shall be independent, impartial and irremovable, in accordance with the law.


(2) The judges of the courts are appointed according to the President of the Republic of Moldova, at the proposal of the Superior Council of Magistracy. Judges who have supported the competition are appointed for the first time for a term of 5 years, then 10 years. After the expiry of the 15-year term, judges will be appointed to office until the age limit is reached.


(3) The President and the members of the Supreme Court of Justice shall be appointed by parliament on a proposal from the Superior Council of Magistracy. They must have a length of service in judges of at least 15 years.


(4) The promotion and transfer of judges shall be carried out only with their consent.


(5) The sanctioning of judges shall be carried out in accordance with the law.


(6) The function of judge is incompatible with any other public or private function, with the exception of teaching and scientific activity.

Artikel I

Parliament adopts this law.

Art.I. - In the Constitution of the Republic of Moldova, adopted on July 29, 1994, (Official Gazette of the Republic of Moldova, 1994, no. 1) the following amendments are made:

     1. In Article 116:

     in paragraph 2:

     the text "after 10 years" is excluded;

     the text "15 years" is replaced by the text "5 years";

     in paragraph 3, the word "members" is replaced by the word "judges".

     2. In Title VII, Article III (6) is replaced by "at least 15 years".
