227

The employee's right to a job that corresponds to the labor protection norms

Each employee has the right to:


a) to have a job corresponding to the labor protection norms;


b) to be compulsorily insured against work accidents and occupational diseases;


c) to obtain from the employer truthful information about the working conditions, about the existence of the risk of health injury and about the protection measures against the influence of the risk factors;


d) to refuse to carry out the works in case of a danger for life or health, until its removal;


e) to be provided, at the employer's expense, with individual and collective protection equipment in the established manner;


f) to be trained in the field of labor protection and to benefit from professional retraining for reasons related to labor protection, at the employer's expense;


g) to address to the employer, employers, trade unions, the central and local public administration authorities, the courts for solving the problems related to labor protection;


h) to participate personally or through his representatives in the examination of issues related to the provision of safe working conditions at his workplace, in the investigation of the work accident or of the occupational disease contracted by him;


i) to be subjected to an extraordinary medical control according to the medical recommendations, with the maintenance of the job and of the average salary during the respective control;


j) to receive the compensations provided by law, by the collective agreements, by the collective contract and by the individual labor contract in case he is employed at work in difficult, harmful and / or dangerous conditions.
