235

Medical service

(1) The medical service is established, obligatorily, in the units that have 300 and more employees. At the units where the number of employees is less than 300, the employer and the employees' representatives will solve the problem of creating the medical service in the process of collective bargaining.


(2) The medical service aims at:


a) organizing and performing, in the manner established by the legislation, the medical control (examination) of the employees both at employment and during the individual employment contract;


b) supervising the observance of the occupational hygiene norms.


(3) In order to fulfill its tasks, the medical service may propose to the employer, based on the corresponding medical certificate, the change, by transfer or exchange, of the workplace or the specifics of the employee's work in connection with his health.


(4) The personnel of the medical service is formed from persons with medical studies, selected by the employer at the proposal of the competent public authority in the field of health care.


(5) The units that have less than 300 employees and that do not have a medical service may call on the services of medical institutions in the established manner.
